The fact that a user of the Site adds items to his basket and confirms his order implies full acceptance of these General Conditions, which alone will be applicable to the contract thus concluded.
The Site contains at all times a commercial proposal for the sale of products, which is not legally considered as a permanent offer. Thus, as will be explained below, the conclusion of a contract will only occur in the event of an order confirmation by LE SOJAMI.
After validation of the payment, in accordance with article 3 of these General Conditions, the order is deemed accepted by LE SOJAMI.
LE SOJAMI will then confirm the acceptance of the order to the user by e-mail or telephone. This confirmation, or if applicable, the refusal to accept an order will thus be confirmed to the user no later than 24 working hours after receipt of an order. LE SOJAMI also reserves the right not to register a payment and therefore not to confirm an order for any reason whatsoever, in particular relating to a problem with the supply of products, a problem concerning the order received, or a foreseeable problem concerning the delivery to be made. LE SOJAMI undertakes, in the event of acceptance of an order, to sell and have delivered to the Customer the products for sale on the Site (the “Products”) ordered by the latter. In this regard, LE SOJAMI undertakes to deliver the Products to the carrier designated by LE SOJAMI on the date defined on the “Delivery” page of the Site: https://lesojami.com/en/delivery/.
The Customer undertakes to provide LE SOJAMI with an address to which delivery can be made during business hours and compatible with the shipping method chosen. The Customer undertakes to pay the price stipulated for the provision of LE SOJAMI (price of the Products and transport), and to pay or have paid, where applicable, directly to the freight forwarder or carrier, customs duties, the VAT or other taxes due on the occasion of the importation of the products into the country of the place of delivery.
The Customer is prohibited from reselling the Products. Any order placed by a Customer is for his personal use or for the personal use of the person in whose name the delivery is to be made. In the latter case, the Customer guarantees the personal acceptance of these General Conditions by the recipient of the delivery (who for this will be assimilated to the “Customer”).
The aggregate price indicated in the order confirmation by LE SOJAMI (the “Price”) is the final price. The Price includes the price of the Products, handling, packaging and transport costs.
The Price is expressed in Euro, the amounts which could be expressed in other currencies being provided for information only. The payment of the Products is made only by bank card. The debit on the Customer’s bank card will be made in Euros upon acceptance of the order by LE SOJAMI. An invoice can be established by LE SOJAMI, at the specific request of the Customer by e-mail addressed to lesojami@lesojami.com which must specify the invoicing address.
The Products are delivered to the delivery address indicated in the order within a period consistent with the shipping method chosen by the Customer, unless payment has not been made for any reason whatsoever. The deadlines communicated to the Customer by LE SOJAMI vary according to the zones. These are indicated for information only on the Site, LE SOJAMI can not be held responsible for exceeding the indicative deadlines given on the Site or during the confirmation of the order. In the event of the absence of the recipient or of a person who can take possession of the Products upon delivery, the carrier will invite the Customer to collect the Products or to schedule a new delivery slot by sending an e-mail to the e-mail address provided by the Customer a notification of passage. Under no circumstances can LE SOJAMI be responsible for any deterioration of the Products in the event of late collection of the said Products from the carrier, or non-collection of the Products by the Customer.
The transfer of risk on the Products takes place upon delivery of the Products by LE SOJAMI to the carrier. Thus, the Products travel at the Customer’s risk and peril.
The Customer may only make reservations upon delivery of the Products in the event of delivery not conforming quantitatively to the order, or in the event that the package containing the Products is severely damaged. These reservations must be made in writing to the carrier upon delivery, or no later than 12 hours after delivery. A copy of these reservations must be sent to LE SOJAMI by e-mail or via the contact form available on lesojami.com no later than 12 hours after these reservations have been made. It is the Customer’s responsibility to provide with this shipment to LE SOJAMI confirmation by the carrier of the reality of these reservations.
No return of Products will be accepted. If the above procedure has been followed, and if it is thus proven that the reservations are due to the fact that the package and the Products are badly damaged, LE SOJAMI at its option will reimburse the Customer for the Price paid or will make a new delivery of similar products.
If the delivery does not quantitatively conform to the Order, LE SOJAMI will only reimburse the difference in price between the Products ordered and those delivered, of course, only if the Products delivered are of a lower price than those ordered and paid for. No reservations can be made in relation to the taste, appearance or freshness of the Products.
LE SOJAMI guarantees that the Products are manufactured in France and that they have been subject to all the necessary care to ensure their conformity with the description which appears on the Site on the date of the order. LE SOJAMI also guarantees that the Products are of very good quality and are fresh when handed over to the carrier. This is the only guarantee granted by LE SOJAMI. No other express or implied warranty is granted. In particular, LE SOJAMI can not guarantee that the Products meet the specific expectations of the Customer.
The Customer is solely responsible for the choice of Products, their conservation from delivery and their use. Under no circumstances can LE SOJAMI be held liable for any damage resulting from this. Similarly, LE SOJAMI could not be held responsible for non-compliance with the legislative or regulatory provisions in force in the country of delivery, LE SOJAMI being solely responsible for compliance with French regulations relating to the Products. In any event, regardless of the possible reason for LE SOJAMI’s liability, LE SOJAMI’s liability is limited to the lower of the following two sums: (i) amount of the direct damage suffered by the Customer , or (ii) order price.
